                                 Makeup/Hair Contract Terms and Conditions

Definitions:

 

 ‘Make-up Artist’ means the party providing a make-up artistry service in the normal course of business.

 ‘Client’ means the person, party or corporate body commissioning a make-up service in accordance with these Terms under the normal course of business. 

 ‘Assignment’ means the period during which the Make-up Artist is to render services to the Client.

 Contract means the contract for the provision of the Specified agreement to which these terms appended;

Specified agreement/Service means the service to be supplied by the Make-up Artist to the Client and to any third parties at the Client’s request and referred to in the contract.

 

 

 1.   Supply of the Specified Service           

  1.1  The Client shall ensure that the Supplier is provided with all necessary access to the premises or site where the Specified Service is to be performed and shall take all necessary steps to ensure that the Specified Service can be performed in a safe and healthy working environment.

1.2  The Supplier may at any time without notifying the Client make any changes to the Specified Service which are necessary to comply with any applicable safety or other statutory requirements, or which do not materially affect the nature or quality of the Specified Service.

 1.3  Terms and conditions, prices and services are subject to change with prior warning or notification. 

 

 

  2.   Fees: (binding) Quotations and (non-binding) Estimates

 2.1   In the absence of any specific agreement, the fee to be charged shall be determined by the Make-up Artist on the basis of the Client’s description of the assignment and purpose of make-up artistry and any instructions given by the client.

 2.2   Any fee quoted, estimated or agreed by the Make-up Artist on the basis of the Client’s description of the task may be subject to amendment by agreement between both parties if, in the Make-up Artist’s opinion on arrival, that description is materially inadequate or inaccurate.

 2.3   An estimate shall not be considered contractually binding, but given for guidance or information only.

 2.4   A binding contract, once given shall remain valid for a period of thirty days from the date on which it was given, after which time it may be subject to revision.

2.5 To secure your date non-refundable deposit is required. By no means and circumstance deposit should be refundable if client breach terms of contract (ex. cancelation of the event). By paying deposit you agreeing to terms and conditions.

2.6 Arranging a trial does not reserve the Make-up Artist’s services for the event.

 

 3.   Payment

  3.1   Payment in full or settlement of any invoice or part-invoice to the Make-up Artist shall be effected not later than on a day of event. The trial is paid for at the time of trial.

 3.2   For long assignments, the Make-up Artist may request an initial payment and periodic partial payments on terms to be agreed.

 3.3   Interest shall automatically be applied at the rate of 10% per annum over base rate to all overdue sums from the date on which they first become overdue until they are paid in full.

 3.4   Where delivery is in instalments and notice has been given that an interim payment is overdue, the Make-up Artist shall have the right to stop work on the task in hand until the outstanding payment is made or other terms agreed.

  3.5   This action shall be without prejudice to any sums due and without any liability whatsoever to the Client or any third party.

 

 4.   Cancellation

 4.1   If an assignment is commissioned and subsequently cancelled, reduced in scope or frustrated by an act or omission on the part of the Client or any third party the Client shall pay the Make-up Artist the full contract sum unless otherwise agreed in advance.

 4.2   If a Client has a receiver appointed or becomes insolvent, bankrupt or enters into any arrangement with creditors the Make-up Artist shall have the right to terminate a contract.

 4.3   The Make-up Artist shall not be liable to the Client or any third party for consequences, which are the result of circumstances wholly beyond the control of either party.

 4.4  The Make-up Artist shall notify the Client as soon as is reasonably practical of any circumstances likely to prejudice the Make-up Artist’s ability to comply with the terms of the Client’s order, and assist the Client as far as reasonably practical to identify an alternative solution.

4.5 The Make-up Artist will be under no obligation to refund any money paid up until point of cancellation, however the client will not be liable for any further payments.

4.6 Cancellations by the Make-up Artist due to circumstances including, but not limited to, problems rendering the Make-up Artists performance of their obligations where no other suitable alternative can be given a full refund will be given to the client. No further compensation will be offered.

 

 5.   Disputes

  5.1   These Terms (together with the terms, if any, set out in the contract) constitute the entire agreement between the parties, supersede any previous agreement or understanding and may not be varied except in writing between the parties.  All other terms, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.

 5.2   If a dispute cannot be resolved amicably between the parties, or if either party refuses to accept arbitration, the parties shall be subject to the jurisdiction of the Courts of England and Wales.

  5.3   In any event these terms shall be construed in accordance with English law.

 

 6.  Responsibility and liability

 6.1   The assignment shall be carried out by the Make-up Artist using reasonable skill and care.

 6.2   The liability of the Make-up Artist shall be limited to the invoiced value of work, unless the potential for such liability is expressly notified to the Make-up Artist in writing prior to commencement of assignment.

 6.3  The make-up artist shall have no liability to the Client for any loss, damage, costs, expenses or other claims for compensation arising from any provision of the Specified Service based upon Input Material or instructions supplied by the Client which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or arising from their late arrival or non-arrival, or any other fault of the Client.

6.4   All brushes and makeup products are kept sanitary and are sanitized between every makeup application. Makeup products used are hypoallergenic.  Any skin condition should be reported by the client to the makeup artist prior to application and, if need be, a sample test of makeup may be performed on the skin to test reaction. Client(s) agree to release the Make-up Artist, from liability for any skin complications due to allergic reactions.

6.5   The make-up artist shall not be liable to the Client or be deemed to be in breach of the Contract by reason of any delay in performing, or any failure to perform, any of the Supplier's obligations in relation to the Specified

Service, if the delay or failure was due to any cause beyond the make-up artist's reasonable control, including any fault or failure of the Client.

 

 

By signing the "Terms and Conditions" you agree that you have read, understand, and accept the terms and conditions described above and you agree to be bound by these Terms of Service and all terms, policies and guidelines incorporated in the Terms of Service by reference. If you do not agree to this Agreement, you should not use the Services (as defined above) in any way. The Services are offered to you conditioned on your acceptance without modification of this Agreement, including without limitation, Aleksandra’s Guz right to use all data collected and analysed by the Services.
